These Terms of Service ("Terms") govern your use of CardPawn's website (cardpawn.ca) and pawn loan services. By submitting a loan application or accepting a loan offer, you agree to these Terms in full.
1. The Pawn Loan Agreement
When you accept a loan offer from CardPawn, you enter into a Pawn Loan Agreement ("Agreement"). The Agreement constitutes the entire legal arrangement between you and CardPawn Inc. Key terms are set out in the Agreement itself and summarized here for convenience only β the Agreement governs in case of conflict.
2. Loan Terms
- Standard term: 90 days from the date of card receipt
- Renewal: Loans may be renewed in 30-day increments by paying the applicable monthly holding fee before the due date
- Early repayment: Permitted at any time without penalty. Interest accrues daily; only days used are charged on early repayment.
- Monthly fee: Calculated as a percentage of the outstanding principal balance per our published rate schedule
3. Collateral
The cards you submit as collateral ("Collateral") remain your legal property during the loan term. CardPawn takes custody, not ownership, of the Collateral. Ownership transfers to CardPawn only upon default as described in Section 6.
4. Storage and Care
CardPawn will store Collateral in a climate-controlled, insured vault facility. We will maintain Collateral in the same or better condition as received. We will photograph all Collateral upon receipt and maintain a secure digital record available to you on request.
5. Insurance
CardPawn maintains specialist collectibles insurance covering Collateral for its full appraised value during storage. Transit to and from CardPawn is insured via our prepaid shipping labels up to $50,000 per shipment (higher coverage arranged separately at no cost for qualifying collections).
6. Default and Forfeiture
A loan is in default if: (a) you fail to pay any monthly fee within 30 days of its due date after a 5-day grace period; or (b) you have not repaid the full principal and accrued fees by the end of an active loan term without arranging a renewal.
Upon default, CardPawn will make reasonable efforts to contact you to arrange repayment or renewal. If no resolution is reached within 15 days of default notice, ownership of the Collateral transfers to CardPawn in full settlement of the outstanding debt. No additional amounts are owed by you after forfeiture.
7. Representations
By submitting Collateral, you represent that: (a) you are the sole legal owner of the cards; (b) the cards are free of any other liens or encumbrances; (c) the cards are genuine and unaltered; (d) you are at least 18 years old and a Canadian resident.
8. Limitation of Liability
CardPawn's liability for any loss of or damage to Collateral is limited to the appraised value stated in your Loan Agreement. We are not liable for any consequential, indirect, or market-value losses beyond this amount.
9. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
